The contractor must collect and seal letters, notes, minutes of meetings, electronic archives and even metadata that can prove that the official agreed with the European Commission and the Council of the European Union in the summer. For each day of delay, the central bank asks Euroclear to impose a fine of 500 thousand euros, but in total no more than 10 million euros. The central bank believes that Euroclear and European officials jointly prepared the EU sanctions regulations adopted on July 26, which prohibit the enforcement of any decision by Russian courts in Europe. According to the regulator's lawyers, the amendments "miraculously appeared" immediately after they raised these issues in a Belgian court. Euroclear has had so many meetings with senior EU officials that the adjusted text cannot be an accident, they claim. Euroclear is challenging the Central Bank's demands and will respond to them during the process, a source close to the issue told Ashpa. Hearings are scheduled for February and March 2027. Euroclear has frozen approximately 210 billion euros of assets of the Russian central bank since 2022. In May, the Moscow Arbitration Court recovered 200 billion euros in blocking losses from the depositary in favor of the central bank and ordered immediate enforcement. The July regulation prevents its application in the European Union. Belgium remains against the confiscation of Russian assets. On October 21, Prime Minister Bart de Weber recalled in Parliament that he had explained to the European Council the legal, economic and financial consequences of such a decision.
