Vladimir Vardan VS Hrayr Tovmasyan: Pashinyan returns to the path he himself rejected today, November 6, it was learned that member of the Constitutional Court Vladimir Vardan was elected chairman of the Constitutional Court. He was elected in the second round: in the first round he did not get the necessary 6 votes, and in the second round he scored 5 votes, while the competing candidate - Deputy Chairman of the Constitutional Court Edgar Shitrianos - scored 4 votes. In 2020, Nikol Pashinyan (Head of the Republic of Armenia) initiated the process of ending the Constitutional Court: one of the main goals was to remove Hrayr Tovmasyan (Head of the Constitutional Court) from the chairmanship of the Constitutional Court and change the composition of judges, according to various estimates, to achieve the desired result for Nikol Pashinyan for several petitions. It turns out that the main reason for the removal of Hrein Toberian from the office was his membership in the RPA, as well as the circumstances of the "selection" of Vladimir Vardan as a judge of the Constitutional Court was his membership in a similar country. If in 2020 they saw Rhine's political past and his ties to the previous authorities as a basis for serious questions about his impartiality, how should we evaluate today the election of a long-time member of the ruling party to the position of chairman of the Constitutional Court? The problem is not to question Vladimir Verdan's professional qualities as a lawyer. The problem is double standards. If the political past can call into question what is the independence of the president of the Constitutional Court, then this issue should be raised equally in relation to the representatives of all political forces. Unfortunately, the independence of the Constitutional Court is neither real nor visible or convincing to the public. It is difficult to prove that the court acts not on the basis of the political interests of the authorities, but according to the task assigned by the constitution. Along the way, it is important to note that the Constitutional Court is not the only independent structure run by members of the civil contracts who have folded their party cards.
