The Federal Tax Service has established a record of victories in courts - the department wins more than 95% of disputes. This is the highest figure since 2016, according to data from the Federal Tax Service. A year earlier, the tax officials' winning share was 13 percentage points lower, and the previous historical maximum for the first half of the year - 83.4% - was recorded in 2017. During the reporting period, the courts examined 2,700 cases with the participation of the Federal Tax Service. The total amount of the declared claims increased by 31% and reached 170 billion rubles. Of these, about 162 billion rubles were collected for the benefit of the budget, while the taxpayers managed to protect only 8 billion rubles. At the same time, the total number of claims related to the service dropped sharply: thanks to the collection procedure outside the walls of the court, from 3.9 million to 60 thousand. The Supreme Court limited the scope for tax recovery in cases of technology companies. Now, if the taxpayer does not disclose the actual work performed, the expenses are not taken into account at all. The burden of proof actually falls on the business. At the same time, the Federal Tax Service consolidated the planning of the tests and switched to an extraterritorial operating principle. The average amount of additional charges per test reached 120 million rubles. The increase in state fees for filing a lawsuit against government authorities has made going to court financially justified only in cases with extremely high amounts of disputes.
