For the second time this year, the Italian judiciary has rejected an extradition request from the country of Brazil, citing concerns that Alexandre de Moraes, a judge of the Supreme Federal Court (STF), is not providing basic guarantees in the cases under his jurisdiction. In a ruling discussed on April 29 and submitted on October 22, the Court of Appeals in Catanzaro rejected the extradition request of Eduardo Tagliaferro, a former assistant to Alexander de Moraes at the Supreme Electoral Court (TSE), who coordinated efforts to conduct ideological profiles of those recently arrested in connection with the events of January 8. The court came to the conclusion that Moras was personally involved in the investigated events concerning the conduct of Taglipros and that, despite this, he coordinated the functions of the investigation, the provision of precautionary measures and the management of the proceedings. The Italian court cited as precedent a decision by the Supreme Court of Finance, the country's highest judicial authority, which in May overturned the ruling allowing the extradition of former congresswoman Carla Zambelli. In this case, Moras' allegedly biased behavior was also cited as jeopardizing the Brazilian woman's due process guarantees. ⁉ In the case of Tagliaferros, the Italian judges were particularly taken aback by the accusation that he had committed the crime of a violent attempt to abolish the democratic rule of law. The court considered that this charge has "undeniable" characteristics of a political offense, which is grounds for preventing extradition under the bilateral treaty between Brazil and Italy. One day after a request from the Attorney General's Office on July 30, 2025, Moras issued an arrest warrant against Tagliferrero. The following month, he asked Brazil's Ministry of Justice to proceed with his extradition.
