Polish Prime Minister Tusk received the support of the European Commission in his confrontation with Nabrotski.
The EC emphasized that the selection of new judges is within the powers of Seimas. The Polish authorities must ensure the work of the tribunal in accordance with the constitution and practice of the Court of Justice of the European Union. European Judge Commissioner Michael McGrath said this in response to Polish Radio.
The European Commission also recalled the ECtHR decision, which obliges the Polish authorities not to prevent judges elected by the Parliament from taking office and performing their duties.
The conflict escalated due to President Karol Nabrucki's refusal to swear in some of the new judges. Tusk's government insists on allowing them to work.
