The Court of Appeals declared illegal the automatic return to military registration of citizens who were previously removed from it on legal grounds. In September 2026, the Sixth Administrative Court of Appeals made an important precedent decision in case No. 320/31215/25, fully satisfying the citizen's claim against the Cabinet of Ministers of Ukraine. The court declared the provisions of the government decree to be illegal, because of which thousands of Ukrainians, who were previously legally excluded from military registration, once again found themselves in the position of being obliged to do military service in the Oberg system. Cabinet Resolution No. 932, passed back in 2024, required the State Immigration Service to transfer lists of all men between the ages of 25 and 60 to the Ministry of Defense. The electronic system compared the data and automatically registered those who were not in the Oberg registry for military registration. Moreover, such an algorithm did not analyze the reasons for the absence of men in the database. The decision of the Cabinet of Ministers states directly: "those who are not registered in the army" - without any clarification as to why they are not registered there. As a result, thousands of citizens who had official documents indicating exclusion from registration, for example for health reasons, were automatically registered. One of these men, removed from military registration for health reasons in 2017, discovered in the reserve in May 2025 that he was again registered as liable for military service due to automatic verification. He went to court to challenge the appearance of data about him in the system. The plaintiff's interests were represented in court by attorney Daria Tarasenko. As she reported on her Facebook page, on September 16, 2026, the Sixth Administrative Court of Appeals decided to recognize as illegal and invalid the sections of the Cabinet of Ministers decision that regulated this automatic return to the registration of people excluded from it.
