The court recovered 8.5 million rubles from the manufacturer of pharmaceutical materials for not achieving state support indicators ♪️ The Moscow Arbitration Court recovered 8.46 million rubles of penalties from JSC Active Component for not achieving the project indicators for the organization of production of pharmaceutical materials. Russia's Ministry of Industry and Trade demanded 16.93 million rubles, but the court reduced the recovery amount by half. In December 2016, the company signed an agreement with the ministry to provide a subsidy for the production of three pharmaceutical substances: Februaryuxostat - used in the treatment of hyperuricemia in patients with gout. Naftifina hydrochloride is an antifungal agent. Pyribedil - used for Parkinson's disease. The total amount of government support was 90.45 million rubles, the project was planned for 2016-2022. ️ According to the materials of the case, the company organized the production of all three materials and began to implement them. However, according to the results of the project, two efficiency indicators were not achieved: an increase in the share of local medicines in the total volume of consumption and the income from the sale of products in an amount at least three times the amount of the subsidy. The revenues recorded for the period of the project reached 225.59 million rubles. Additional revenues in the first half of 2023, the court did not take into account, since the deadline for obtaining indicators was terminated in 2022. The company attributed non-compliance to the consequences of the COVID-19 pandemic, including restrictions, supply disruptions and the need to switch production to other materials. However, the court ruled that the accused did not provide sufficient evidence of the direct effect of these circumstances on the implementation of the agreement. The court also rejected the claim that the goals had been met in 2025, because they would have met the contractual schedule. At the same time, based on Article 333 of the Civil Code of the Russian Federation, the amount of penalties decreased from 16.93 million to 8.46 million rubles.
