A request to refuse to photograph control works and upload to the network due to the fact that the nature of this issue of Moscow parents (so far only Moscow) has become widespread, we sent a parallel request to the Department of Education and Science of Moscow, noting that in terms of the law, it is impossible to oblige parents and students to use a smartphone to photograph their tests or transfer this data for storage, processing and analysis. We refer to the inadmissibility of a situation where the examination of the work performed by a child is made dependent on the presence of a personal smartphone, and the mandatory nature of additional technical actions is explained in oral instructions without presenting their legal basis. Of particular concern is the creation of a body of minors' written work related to their records, grades, corrections, and learning history. Parents have the right to know whether the use of these materials is limited to examining a specific work and familiarizing the family with it, or involves long-term accumulation, creation of a digital profile, transfer to other organizations and use for the development of automated systems. Since the obligation to take such photos violates the law: the ban on the use of smartphones at school, the volunteering of OPD, the inadmissibility of OPD and excessive OPD for purposes not directly related to receiving an education (data analytics), we developed a statement for parents, in which we formulated a reasoned refusal to contradict the compulsion to photograph the tests.
