The court collected 2.63 billion rubles from a pharmacy supplier for robots that confused pills and destroyed medicines The Moscow Arbitration Court collected more than 2.63 billion rubles from Hier Electrical Appliances Rus LLC in favor of Gormedtechnika. Robot pharmacies were intended for nine hospitals in the capital, but they were not activated by the deadline. During the trial run, more than 1,300 errors were recorded in the logs. The parties signed the agreement back in September 2024. Initially it cost 2.86 billion rubles, but after additional agreements the price rose to 3.63 billion rubles. The supplier had to not only transport the equipment, but also prepare the site, install and configure systems, connect them to EMIAS, operate them and train personnel. The work was required to be completed by December 31, 2025. Gormedtechnika transferred 3.27 billion rubles to the supplier - in advances of 20% and 70% of the contract value. However, none of the nine systems were activated by the deadline. During trial operation, the robots made mistakes when identifying drugs, counting tablets and reading label codes. They confused drugs, including drugs with similar forms but different pharmaceutical properties. During the packaging, the equipment damaged the tablets and capsules, and their particles entered the bags with other medicines. The court ruled that without constant monitoring by pharmacists, errors of this type could result in a patient receiving a medication that was not prescribed or not receiving a required medication. The supplier claimed that the equipment was transferred to the customer, and the completion of the work was avoided by Gurmedtechnik operations and the need for approvals. The court rejected these claims: the preparation of complexes and the ordering of systems were the responsibility of the supplier. The court collected 2.54 billion rubles of unjust enrichment, 31.6 million rubles of fines and 56 million rubles of interest under Article 395 of the Civil Code of the Russian Federation. In addition, the accused must return 10 million rubles in state fees.
