In the first six months of 2026, the court suspended 1,300 cases against alimony debtors who went to war. This is the first time that the authorities have revealed such statistics. During the first half of 2026, court officials suspended 1,379 criminal cases of failure to pay alimony (Part 1 of Article 157 of the Criminal Law) due to the fact that defendants were called up for military service or entered into a contract with the Ministry of Defense. "Important Stories" drew attention to this after studying the statistics of the Federal Court Service (FSSP). Cases of non-payment of alimony are frozen due to the debtor's departure for military service almost as often as due to his searches: for this reason, arbitrators froze 1,462 cases in six months. A criminal case for failure to pay alimony (Part 1 of Article 157 of the Criminal Law) is opened if a person does not pay it for more than two months after an administrative punishment for the same violation (Article 5.35.1 of the Administrative Law). Participation in the war does not exempt children from obligations. Like other citizens, military personnel may be required to pay one-quarter of their income for one child, one-third for two children, and one-half for three or more children. After signing a contract or enlisting for military service, the criminal case may be stopped, and in the future the debtor may be completely released from criminal liability after receiving military awards, dismissal for health reasons or due to the end of the enlistment, explains a lawyer dealing with the collection of alimony and requested anonymity. In this case, the child's father will avoid criminal liability for non-payment of child support, but the debt itself will remain. The debtor dies, the case will be closed due to his death, and the obligation to pay the alimony debt will pass to the heirs. So far, things are more often suspended than stopped entirely. In the first half of 2026, in connection with the military service, the court and the courts concluded 99 cases of non-payment of alimony. Another 675 cases previously suspended on this basis were renewed. Suspension of criminal cases against war participants in Ukraine was allowed as early as June 2023.
