A | Awaiting critical vote for property developers; Will the court annul the Security Council's decision? ▫ Examining the cancellation of the National Security Council's decision regarding the final demolition votes issued by the Section 100 Committees by the end of 1405 has become a hot legal issue these days. ▫ Hani Agni, lawyer and editor of the program "Dossier", is hosted by Kambiz Khazai, lawyer, on Eco Iran TV, the Iranian economic television, to examine the legal aspects of this decision and its cancellation in a special interview. ▫ The story is that the State Security Council confirms on this day that "final demolition votes issued by Section 100 committees can be converted into fines until the end of 1405". This order was delivered to the provinces of the state in letter number 76/99 of the National Security Council Secretariat, but shortly after, two lawyers asked the Court of Administrative Justice to cancel this order. ▫ According to Article 170 of the Constitution, anyone can request the cancellation of approvals in the form of regulations, circulars, general and comprehensive regulations from the Court of Administrative Justice. ▫ In addition to the cancellation request, these lawyers also requested a temporary order, which means that this decision will not be implemented until the final decision is made by the Court of Justice. ▫ According to Hazai, this ruling was reviewed (or reviewed) by the Lands Council, Councils and the Specialized Environment, and its decision may be given soon. Referring to the possibility that this decision could be canceled due to the issuing of a temporary order by the specialized board, Hazai examined two objections to the National Security Council's decision in terms of the authority of this council as well as the laws related to the rulings of the Section 100 Committee, and finally assessed the legal status of the builders who used the temporary decision from this point of view of a temporary order. This has become a socio-legal problem, suggesting that the Islamic Council should step in and make a decision on this matter.
