The Supreme Court dismissed the pilots' lawsuit against the Ministry of Transportation regarding the working conditions The Appellate Division of the Supreme Court of the Russian Federation confirmed the decision to end the proceedings in the flight crew union lawsuit. Civil aviation pilots demanded the cancellation of departmental order of the Ministry of Transportation No. 381 regulating the standards of work hours and rest between flights for crews. The Supreme Court supported the judge's position, which stopped the case in August, citing procedural rules. According to the ruling, current Russian legislation does not grant trade unions the right to file administrative claims for the protection of an unlimited number of people. Due to this formal reason, the court never addressed the substance of the disputed order itself, which directly affects flight safety. Representatives of the flight squads are sure that officials committed serious procedural violations even at the stage of adopting this regulatory law. Since the refusal of the courts to consider class actions of this type without the participation of specific victims is a standard practice that significantly complicates the work of the trade unions, the trade union now has a last option for legal protection - a complaint to the Constitutional Court of the Russian Federation.
