The Supreme Court ruled that a micro loan issued using a passport photo and an SMS code sent to someone else's number cannot automatically be considered legal. The lenders are required to check whether the owner of the documents actually enters into the agreement. The reason was the case of a resident of Novosibirsk, from whom they tried to collect ₽74,000 for a fraudulent loan: the money went to someone else's card, and a stranger received the confirmation code. The Supreme Court annulled the decisions of the lower courts and sent the case for review. The courts of first instance supported the receivers, and believed that the presence of passport data in the agreement meant the consent of the borrower. However, the Supreme Court disagreed. "The use of passport data and a passport photo does not unconditionally mean that the agreement was signed by the owner of this data," the Supreme Court said in its decision. The court overturned the previous decisions and sent the case for a retrial. Time to close this micro loan shop. Chat | BOT | Site | | YUT.
