Tatalo was initially sentenced to 5 years in prison for the case, but the Supreme Court of the Islamic regime overturned the ruling and sent it to another court in Tehran, which sentenced him to death. The Supreme Court later confirmed the death sentence, with Iran's judiciary saying the verdict is final and ready for enforcement.

Tatalo is already serving a separate 10-year prison sentence for the crime of "encouraging corruption and prostitution" and propaganda against the Islamic Republic.

The 38-year-old singer lived in Istanbul for several years before Turkish authorities handed him over to Iran in December 2023, where he was arrested immediately.
