Lawyer Muthana Nasser to "Sham": Alshami's dismissal was based on the loss of professional conditions, and responsibility is carried out in accordance with the law and the evidence.
Details: Member of the Council of the Bar Association in Aleppo and official of the Communications Committee, Motana Naser, explained in an interview with the "Sham News" network that handling the lawyers' files requires verifying the facts and evidence, distinguishing between union procedures and criminal liability, and guaranteeing the rights of defense. The council of the Aleppo branch of the union based the decision to impeach Muhammad Anas al-Shami on complaints, information and documents that included information about connections to security agencies associated with the former regime, methods aimed at lawyers and the existence of an investigation file related to him, in addition to his previous membership in the former People's Assembly during the former People's regime. The branch council decided to implement the provisions concerning the loss of one of the conditions for practicing the profession in accordance with the Law on the Regulation of the Legal Profession No. 30 of 2010 and the statutes, and to issue a decision to remove him from the list of lawyers. The decision included obliging Alshami to hand over the union card, the logo and the vehicle emblems, stopping the organization of agencies in his name, distributing this to the departments and assembling a committee to take over his office, while officially notifying the decision and notifying the relevant parties for its execution. The direct impact of the decision is limited to the status of the union and the continued fulfillment of professional conditions, while accusations of a criminal nature remain subject to investigation and judgment before the competent judicial authority. Nasser noted that the importance of the decision lies in confirming the union's responsibility to protect the honor of the profession, maintain its independence and increase the trust of the citizens, while emphasizing the need for serious treatment of the previous regime's cases and to hold accountable those whose responsibility has been legally proven, far from revenge or general. Nasser emphasized that mere suspicion is not enough to make a decision on deletion unless the legal basis is available, while explaining the need to distinguish between cancellation due to loss of professional conditions, disciplinary punishments in accordance with Article 85 et seq., and cancellation resulting from a final judgment. He emphasized the referral of suspected criminal acts to the competent judicial authority, while the responsibility of the union remains completely independent of the criminal responsibility.
