The court recovered 2.63 billion rubles from the pharmacy supplier for botched tablets and defective drugs The Moscow Arbitration Court recovered more than 2.63 billion rubles from Hayer Electric Applaensis Rus LLC in favor of Gormedtechnics. Robotic pharmacies were intended for nine hospitals in the capital, but by the deadline they had not been put into operation. During the trial operation, more than 1,300 errors were recorded in journals. The contract was signed by the parties in September 2024. Initially, it cost 2.86 billion rubles, but after additional agreements, the price rose to 3.63 billion rubles. The supplier not only had to deliver the equipment, but also prepare the site, install and configure the systems, connect them to EMIAS, commission and train the staff. The work was required to be done by December 31, 2025. Gormedtechnik transferred 3.27 billion rubles to the supplier in 20% progress and 70% of the contract value. However, none of the nine systems were implemented by the deadline. During the pilot operation, the robots failed to identify drugs, count tablets and read codes. They confuse drugs, including drugs of similar forms but with different medicinal properties. When packaging, the equipment damaged the tablets and capsules, and their particles fell into packages with other drugs. The court noted that without regular supervision of the pharmacists, such errors could lead to the patient receiving a non-prescribed drug or not receiving the necessary. The supplier claimed that the equipment was transferred to the customer, and the completion of the work was delayed by the actions of "Gormedtechnics" and the need for permits. The court rejected these claims: the preparation of the place and the systems committee were the supplier's responsibility. The court recovered 2.54 billion rubles of unjust enrichment, 31.6 million rubles of punishment and 56 million rubles of interest under Article 395 of the Civil Code of the Russian Federation. Also, the accused must return 10 million rubles of the state duty.
