Kyrgyzstan again proposes to introduce separate liability for sexual harassment. The corresponding bill has been submitted for public discussion. Its author is Deputy Jogorku Kenesh Elvira Surabaldieva, who has been dealing with this issue for several years. The document stipulates changes in three pieces of legislation at once: the Offenses Law, the Criminal Law and the Law "On the Basics of Crime Prevention". Harassment is proposed to be understood as unwanted actions of a sexual nature. These include obscene statements and gestures, touching, squeezing, pinching, kissing, caressing and showing genitals. Sending photographs, videos and audio recordings of a sexual nature, making obscene phone calls and stalking may also be punishable if they create a humiliating, offensive or threatening environment for the person. For a first violation, it is proposed to establish a fine of 20 thousand or detention for a period of three to seven days. If the violator commits similar actions again within a year after being prosecuted, he may face a criminal penalty - between two and four years in prison. The draft establishes the same conditions for those who violate the prohibitions and restrictions established by the court, subject to the conditions specified in the document. In addition, the courts will be able to prohibit offenders from contacting and harassing victims. To monitor compliance with the restrictions, it is proposed to use electronic tracking for up to three months. The authors explain the need for changes by the fact that the current legislation does not contain a separate mechanism for imposing responsibility for sexual harassment. The rationale cites research published in the Ombudsman's 2023 report. Out of 250 women and girls surveyed, 90 said they experienced various forms of harassment on public transportation.
